The Fair Credit Reporting Act (FCRA) requires employers and credit reporting agencies to follow a number of different practices and procedures if they choose to supply and/or rely on your credit information, commonly referred to as a “background check.” For example, credit reporting agencies are required to provide you with a notice if they provide a credit report or background check to a third party; and employers are required to notify you in writing of your rights prior to relying on any information they receive as part of a background check or credit report.
